Litigation through the court system can be a slow, expensive and often stressful process. As an alternative, mediation involves the use of a third-party mediator. This person assists the parties in reaching a mutual settlement of a dispute.
Mediation can be a cost-effective dispute resolution process. It allows the parties to be creative in the solution to the dispute. If resolved in court, the dispute might otherwise follow more rigid legal rules and a more timely, costly process. In contrast, private arbitration involves an adjudication of the dispute. The adjudicator is a third party arbitrator outside of the usual court processes.
As a mediator, Amanda Chapman becomes a neutral facilitator, not taking sides, not giving legal advice, and not making decisions. She simply neutralizes the air and guides discussions. When this happens, parties involved are able to explore the issues at hand and find sensible options to resolve their conflict.
